Terms of Service Agreement

This agreement outlines the terms and conditions for commissioning artwork from me, the Artist. Please read and understand these terms before proceeding with your commission. Feel free to reach out if you have any questions.

Businesses, agencies, groups and other organizations should contact me to discuss arrangements in more detail.

Engagement

1.1 Commission Process: The commission process typically takes 3 weeks to 3 months for final artwork delivery. In some cases, larger projects might require more time. I reserves the right to decline commissions that I'm not comfortable with.

 

1.2 Artwork Usage and Streaming: I, the Artist, retain all rights to commissioned artwork, except character design rights, which are shared with the client. Artwork may be streamed on platforms like Twitch and social media. If confidentiality is desired until an official reveal of the piece is made on behalf of the client, please contact me to make arrangements. For complete secrecy, refer to the NDA section for pricing.

 

1.3 Content Restrictions: I, the Artist, will not create explicit, offensive, or inappropriate content. Other specific restrictions include, but are not limited to, Furry, NSFW, Mecha, Animals, and hyper-realistic representations of real people.

Payments and Fees

2.1 Payment Method: Payments for commissions are made through PayPal invoices in EUR (Euro €) currency.

 

2.2 Refunds: Refunds will be issued as follows:

  • Cancellation before the sketching phase commences: Full refund.

  • Refund request during the sketching phase: Partial refund, with the Artist retaining 50% of the refunded amount.

Commercial Use

Additional fees apply for commercial use of commissioned artwork based on the type of usage:

  • x2 fee for promotional purposes like Twitch/Youtube banners, alerts, panels, etc.

  • x3 fee for merchandise like stickers, mousepads, mugs, shirts, etc.

  • Illustration for Twitch/Youtube emotes and Live2D Models have no additional fee.

Commission Process

4.1 Submission: Submit commission requests through the provided Google Form.

 

4.2 Acceptance and Invoicing: I will notify you if the commission is accepted. Further details will be discussed, and an invoice will be sent to your provided PayPal address.

 

4.3 Sketching Stage: During the sketching stage, you'll receive a screenshot of the work. You can request major changes at this point. You are entitled to 3 free revisions; after the third revision, additional changes cost 100€ per change, limited to 2 extra revisions. Note that near completion, revisions might not be possible.

 

4.4 Updates and Communication: I may not work during weekends, but expect responses to your messages. Delays might occur on weekends due to the Artist's non-working hours.

 

4.5 Final Changes: Once the work is completed, you'll receive a high-resolution file. You can ask for minor changes like lineart or coloring mistakes.

Rights and Usage

5.1 Ownership and Shared Rights: I, the Artist, retain full ownership rights to commissioned artwork. However, you retain shared rights exclusively for character designs, actively shaping your characters while acknowledging the Artist's ownership.

Additional Notes

6.1 NDA and Additional Costs: An NDA (Non-Disclosure Agreement) incurs an additional cost of 100€.

 

6.2 Work Queue: I may have commissions before yours, and they will be worked on in order.

 

6.3 NSFW Content: Do not use the Artist's artwork for any NSFW (Not Safe for Work) content.

Indemnification

You indemnify the Artist against claims, losses, damages, and expenses related to Work usage by you, breach of the Agreement, or third-party claims. The Artist will work to remedy the situation if your rights are violated or the Work is not delivered as agreed.

Acceptance

By proceeding with your commission, you confirm that you are 18+ or have a legal guardian making the agreement on your behalf. Agreement date is upon first inquiry/communication or first transaction.
